Resolution Number 03-11 Transferring Property

RESOLUTION NUMBER 03-11

AUTHORIZING THE CONVEYANCE OF OWNERSHIP INTERESTS HELD BY THE FORMER EAST MESABA SANITARY DISPOSAL AUTHORITY TO THE STATE OF MINNESOTA.

WHEREAS, The Town of Fayal was a party to the East Mesaba Sanitary Disposal Authority (the Authority), organized under a Joint Powers Agreement, which operated a mixed municipal solid waste disposal facility until 1994. At that time, the authority entered into a “Landfill Cleanup Agreement” (the Agreement) with St. Louis County and the Minnesota Pollution Control Agency; and

WHEREAS, The East Mesaba Sanitary Disposal Authority was disbanded in May of 1996 and all assets then remaining were distributed to the entities party to the Joint Powers Agreement: and

WHEREAS, The Agreement stipulates that certain real property then owned by the Authority be conveyed to the State of Minnesota (State) acting through its Commissioner of the Pollution Control Agency; and

WHEREAS, The Warrantee Deed, drafted by the state in 1996, for the purpose of said conveyance did not include all real property then held by the Authority in Section 15, Township 58 North of Range 17 West of the Fourth Principal Meridian as intended by the agreement.

NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Fayal Township hereby agrees to the conveyance of any and all property still owned by the East Mesaba Sanitary Disposal Authority in said Section 15 to the State of Minnesota.

DULY ADOPTED BY THE CITY COUNCIL THIS 7th DAY OF MARCH, 2011.
