Resolution 40-02 Ordering Plans

WHEREAS, a certain petition requesting the improvement of the proposed commercial development located in the Northwest Quarter of the Southeast Quarter and the Southwest Quarter of the Northwest Quarter of Section 11, Township 58 North, Range 18 West, all in the City of Mountain Iron, St. Louis County, Minnesota hereby petition that such property be improved by the installation of infrastructure was duly presented to the City Council on the 3rd day of September, 2002 and

WHEREAS, pursuant to Resolution of the City Council adopted September 3, 2002, a report has been prepared by Benchmark Engineering with reference to the improvement, and this report was received by the City Council on September 3, 2002;

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MOUNTAIN IRON, MINNESOTA:

1. The City Council finds and determines that said petition was signed by all owners of real property abutting upon the proposed development as the location of the improvement.

2. Such improvement is hereby ordered as proposed in the City Council Resolution adopted September 3, 2002.

3. Benchmark Engineering is hereby designated as the engineer for this improvement. They shall prepare plans and specifications for the making of such improvement.

4. The City Council declares its official intent to reimburse itself for the costs of the improvement from the proceeds of the tax exempt bond.

DULY ADOPTED BY THE CITY COUNCIL THIS 5TH DAY OF AUGUST, 2002.
