RESOLUTION NUMBER 35-17

 

VACATING A PARK DESIGNATION

 

WHEREAS, the City Council previously passed Resolution Number 31-17 noting its interest in vacating a park designation legally described as:

 

That part of the Plat of SOUTH GROVE ADDITION to the City of Mountain Iron designated in said plat as “Park” except those parts described as follows:

 

  • Beginning at the Northeast Corner of Outlot A in Plat of SOUTH GROVE ADDITION TO MOUNTAIN IRON and assuming the East line of Outlot A to bear North 03 degrees 37 minutes 32 seconds West; thence North 03 degrees 37 minutes 32 seconds West 168.98 feet; thence South 85 degrees 57 minutes 38 seconds West parallel to the North line of said plat 111.23 feet; thence Southwesterly 31.55 feet along a tangential curve concave to the Southeast, radius of 20.00 feet and a central angle of 90 degrees 23 minutes 10 seconds; thence South 04 degrees 25 minutes 32 seconds East tangent to said curve 149.71 feet to the Northwest Corner of said Outlot A; thence North 85 degrees 34 minutes 28 seconds East along the North line of Outlot A 129.00 feet to the Point of Beginning, containing 0.50 acres. AND EXCEPT

 

  • Beginning at the northeast corner of Lot 1 Block 12 of said SOUTH GROVE ADDITION; thence North 04 degrees 25 minutes 32 seconds West along the northerly extension of the east line of said Lot 1 for a distance of 203.29 feet to the north line of said PARK; thence South 85 degrees 57 minutes 38 seconds West along said north line for a distance of 765.52 feet to the northwest corner of said PARK; thence South 04 degrees 25 minutes 32 seconds East along the west line 208.45 feet to the southwest corner of said PARK; thence North 85 degrees 34 minutes 28 seconds East along the south line of said PARK 756.50 feet to the point of beginning.

 

All as shown on Exhibit A attached hereto, the area vacated being marked in dots.

 

and setting a public hearing to consider the vacation of such designation; and

 

WHEREAS, a public hearing to consider the vacation of such street was held on the 18th day of December, 2017, before the City Council in the City Hall located at 8586 Enterprise Drive North, Mountain Iron, Minnesota, at 6:30pm after due published and posted notice had been given, as well as personal mailed notice to all affected property owners by the City Administrator on the 27th day of November, 2017 and all interested and affected persons were given an opportunity to voice their concerns and be heard; and

 

WHEREAS, any person, corporation or public body owning or controlling easements contained upon the property vacated, reserves the right to continue maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair, replace or otherwise attend thereto; and

 

WHEREAS, the Council in its discretion has determined that the vacation will benefit the public interest because it has never been used as a park and there is no foreseeable use for the park designation in or Comprehensive Plan.

 

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MOUNTAIN IRON, COUNTY OF SAINT LOUIS MINNESOTA, that such vacation is hereby granted and the park designation described as follows is hereby vacated:

 

That part of the Plat of SOUTH GROVE ADDITION to the City of Mountain Iron designated in said plat as “Park” except those parts described as follows:

 

  • Beginning at the Northeast Corner of Outlot A in Plat of SOUTH GROVE ADDITION TO MOUNTAIN IRON and assuming the East line of Outlot A to bear North 03 degrees 37 minutes 32 seconds West; thence North 03 degrees 37 minutes 32 seconds West 168.98 feet; thence South 85 degrees 57 minutes 38 seconds West parallel to the North line of said plat 111.23 feet; thence Southwesterly 31.55 feet along a tangential curve concave to the Southeast, radius of 20.00 feet and a central angle of 90 degrees 23 minutes 10 seconds; thence South 04 degrees 25 minutes 32 seconds East tangent to said curve 149.71 feet to the Northwest Corner of said Outlot A; thence North 85 degrees 34 minutes 28 seconds East along the North line of Outlot A 129.00 feet to the Point of Beginning, containing 0.50 acres. AND EXCEPT

 

  • Beginning at the northeast corner of Lot 1 Block 12 of said SOUTH GROVE ADDITION; thence North 04 degrees 25 minutes 32 seconds West along the northerly extension of the east line of said Lot 1 for a distance of 203.29 feet to the north line of said PARK; thence South 85 degrees 57 minutes 38 seconds West along said north line for a distance of 765.52 feet to the northwest corner of said PARK; thence South 04 degrees 25 minutes 32 seconds East along the west line 208.45 feet to the southwest corner of said PARK; thence North 85 degrees 34 minutes 28 seconds East along the south line of said PARK 756.50 feet to the point of beginning.

 

All as shown on Exhibit A attached hereto, the area vacated being marked in dots.

 

BE IT FURTHER RESOLVED, that the Mayor and City Administrator are hereby authorized to sign all documents necessary to effectuate the intent of this resolution.

 

DULY ADOPTED BY THE CITY COUNCIL THIS 18th DAY OF DECEMBER, 2017.
