Resolution 28-05 Vacating Certain Streets

RESOLUTION NUMBER 28-05

VACATING STREETS IN PARKVILLE 2nd ADDITION

WHEREAS, the majority of the owners abutting Falcon Avenue (formally 2nd Street) from Heron Street (formally 2nd Avenue) to County Road 102 and Eagle Avenue (formally 1st Street) from Heron Street (formally 2nd Avenue) to County Road 102 in the Parkville Second Addition, City of Mountain Iron, have requested the City Council in a petition dated July 14, 2005, to vacate such streets according to law; and,

WHEREAS, a public hearing was held on September 6, 2005, before the City Council in the Community Center on such petition after due published and posted notice has been given, as well as personal notice to affected property owners by the City Administrator on August 12, 2005, and all persons interested were given an opportunity to be heard; and,

WHEREAS, any person, corporation or City owning or controlling easements contained upon the property vacated, reserves the right to continue maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove or otherwise attend thereto; and,

WHEREAS, it appears that it will be in the best interest of the City to approve such petition.

NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF MOUNTAIN IRON, MINNESOTA, that a portion of such petition is hereby granted and the streets described as follows are hereby vacated:

Falcon Avenue (formally 2nd Street) from Heron Street (formally 2nd Avenue) to County Road 102 and Eagle Avenue (formally 1st Street) from Heron Street (formally 2nd Avenue) to County Road 102 in the Parkville Second Addition, City of Mountain Iron, Minnesota.

DULY ADOPTED BY THE CITY COUNCIL THIS 6th DAY OF SEPTEMBER, 2005.
