RESOLUTION NUMBER 20-00

CARRIAGE HOMES PLANNED UNIT DEVELOPMENT

WHEREAS, on March 25, 1996, the Mountain Iron the Planning and Zoning Commission held a public hearing to consider a request to designate the following parcels of land as Planned Unit Development (“PUD”) within the meaning of Chapter 22 of the City Code of the City of Mountain Iron (Land Use and Zoning Resolution):

The Westerly 436 feet of the Northerly 500 feet of the Northwest Quarter of the Southwest Quarter (NW 1/4 of SW 1/4), Section 12, Township 58 North, Range 18 West (containing 5 acres more or less);

and,

WHEREAS, on March 25, 1999, the Planning and Zoning Commission recommended to the City Council that the request for establishment of a PUD for the above described property be approved (hereinafter referred to as “Park View PUD”); and,

WHEREAS, on April 1, 1996, the Mountain Iron City Council considered the recommendation by the Planning and Zoning Commission for approval of the Park View PUD an adopted a motion to table the recommendation of the Planning and Zoning Committee regarding approval of the Park View PUD: and,

WHEREAS, the City Council of Mountain Iron has taken no further action on the recommendation of the Planning and Zoning Commission regarding the Park View PUD; and,

WHEREAS, by Document No 628670, dated May 5, 1997, and recorded May 14, 1997, CIC Number 30, Carriage Homes of Mountain Iron CIC Plat was established pursuant to Minnesota Law on a portion of the above described property (containing 2.62 acres, more or less,); and,

WHEREAS, by virtue of Minnesota Statutes 15.99, Subd. 1 and 2, the failure of the City Council to take further action on the request for the establishment of Park View PUD, said request is automatically approved as a matter of law; and,

WHEREAS, the Carriage Homes common interest community has been developed and completed in a manner consistent with the Planning and Zoning Commission’s approval of a PUD known as Park View PUD for the above described property; and,

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MOUNTAIN IRON, MINNESOTA, that the above-described property, including but not limited to the CIC Number 30, Carriage Homes of Mountain Iron CIC Plat, is hereby designated as a PUD pursuant to Chapter 22 of the Code of the City of Mountain Iron; and,

BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF MOUNTAIN IRON, MINNESOTA, that the City Administrator, the City Zoning Administrator, and all other appropriate city personnel be directed to make the appropriate modifications to the city zoning map and related city records to correctly reflect the zoning designation of the above-described property as a Park View PUD; and,

BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF MOUNTAIN IRON, MINNESOTA, that the record of this City action be memorialized by the City Clerk in a recordable form, so that individual property owners may, if they desire at any future time, record this resolution against the title to the property in the land records of Saint Louis County.
