RESOLUTION NUMBER 04-26

ACCEPTING WASTEWATER TREATMENT FACILITY PLAN PREPARED BY MSA PROFESSIONAL SERVICES, INC.

WHEREAS, the City of Mountain Iron (“City”) owns and operates a municipal wastewater treatment facility and sanitary sewer co11ection system subject to regulation by the Minnesota Pollution Control Agency (MPCA) pursuant to Minnesota Statutes Chapter 115 and Minnesota Rules Chapters 700), 7050, 7060, and 7077; and

WHEREAS, Minnesota Rules Chapter 7077 requires municipalities proposing construction, modification, or expansion of wastewater treatment facilities to prepare and submit a Facility Plan for MPCA review and approval; and

WHEREAS, the City retained MSA Professional Services, Inc. to prepare a Wastewater Treatment Facility Plan in accordance with Minnesota Rules Chapter 7077 and applicable MPCA guidance; and

WHEREAS, the Facility Plan includes, at a minimum, the following elements as required under Minnesota Rules Chapter 7077:

  1. Purpose and Scope of the Facility Plan, including identification of infrastructure needs, regulatory requirements, and long-tern wastewater management objectives; and
  2. Future Effluent Limits, including anticipated National Pollutant Discharge Elimination System/State Disposal System (NPDES/SDS) permit requirements and projected regulatory changes; and
  3. Projected Wastewater Flows and Loadings, including current and projected population, industrial contributions, infiltration and inflow considerations, and design year projections; and
  4. Treatment Alternatives Considered, including evaluation of feasible wastewater treatment technologies, system upgrades, rehabilitation options, and regionalization considerations; and
  5. Recommended Alternative and Reasons for Selection, including evaluation criteria such as regulatory compliance, reliability, sustainability, operational complexity, environmental impact, and lifecycle cost; and
  6. Estimated Project Costs, including planning-level capital costs, contingencies, engineering, legal, administrative, and financing costs; and
  7. Estimated Impact on Sewer Rates, including projected user rate adjustments necessary to finance capital improvements and maintain financial sustainability; and
  8. Location of the Recommended Project, including site considerations, property requirements, and consistency with local land use controls; and
  9. Schedule for Implementation, including anticipated design, permitting, bidding, construction, and project closeout timelines; and

WHEREAS, the City Council has reviewed the Facility Plan prepared by MSA Professional Services, Inc. and in the best interests of the City and its residents; and

WHEREAS, the City intends to submit the Facility Plan to the Minnesota Pollution Control Agency for review and approval pursuant to Minnesota Rules Chapter 7077 and to pursue applicable state and federal funding opportunities, including but not limited to the Minnesota Public Facilities Authority (PFA) Clean Water Revolving Fund.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MOUNTAIN IRON, MINNESOTA, that the City Council hereby accepts the Wastewater Treatment Facility Plan prepared by MSA Professional Services, Inc.

DULY ADOPTED BY THE CITY COUNCIL THIS 17th DAY OF FEBRUARY, 2026.
