MOUNTAIN IRON CITY COUNCIL
November 7, 2016
Mayor Skalko called the City Council meeting to order at 6:30p.m. with the following Council members present: Alan Stanaway, Tony Zupancich, and Mayor Gary Skalko. Also present were: Craig J. Wainio, City Administrator; Amanda Inmon, Municipal Services Secretary; Sally Yuccas, Librarian Director/Special Events Director; John Backman Sheriff’s Department and Rod Flannigan, City Engineer. Following Council members absent: Joe Prebeg, Jr., Susan Tuomela.
It was moved by Skalko and seconded by Zupancich that the consent agenda be approved as follows:
- Add the following items to the agenda:
IV. A. 3. Donation to Senior Citizen’s Annual Holiday party
A. 4. Cross Country donation
- Approve the minutes of the October 17, 2016, regular meeting as submitted.
- That the communications be accepted and placed on file and those requiring further action by the City Council be acted upon during their proper sequence on the agenda.
- To acknowledge the receipts for the period October 16-31, 2016 totaling $224,796.90 (a list is attached and made a part of these minutes).
- To authorize the payments of the bills and payroll for the period October 16-31, 2016, totaling $684,847.43 (a list is attached and made a part of these minutes).
The motion carried with Councilor Prebeg and Tuomela absent.
At 6:34 p.m., it was moved by Zupancich and seconded by Stanaway to recess the regular meeting and open the public hearing for the proposed vacation of park in South Grove. The motion carried with Prebeg and Tuomela absent.
Van Fitch was interested in regards to a map where property ends, and other properties start, boundary lines. Councilor Zupancich stated that the Vacate property first, City Staff must work with City Engineer in regards to easements and mapping of lots. Each lot would be the equal to the width of the residents’ current property and would only be available to those residents whose property it is behind.
At 6:40p.m., it was moved by Zupancich and seconded by Stanaway to close the public hearing and reconvene the regular meeting. The motion carried with Prebeg and Tuomela absent.
It was moved by Zupancich and seconded by Stanaway to adopt Resolution Number 45-16; vacating the park designation to those lots in South Grove, described as follows. Beginning at the northeast corner of Lot 1 Block 12 of said SOUTH GROVE ADDITION; thence North 04 degrees 25 minutes 32 seconds West along the northerly extension of the east line of said Lot 1 for a distance of 203.29 feet to the north line of said PARK; thence South 85 degrees 57 minutes 38 seconds West along said north line for a distance of 765.52 feet to the northwest corner of said PARK; thence South 04 degrees 25 minutes 32 seconds East along the west line 208.45 feet to the southwest corner of said PARK; thence North 85 degrees 34 minutes 28 seconds East along the south line of said PARK 756.50 feet to the point of beginning (a copy is attached and made a part of these minutes). The motion carried with Prebeg and Tuomela absent.
Mayor’s Report:
- Condolences to the family of Evelyn Witzman
- Met with Country Kitchen officials, closed officially Tuesday, November 1st at 3pm, future development planned for that area
It was moved by Stanaway and seconded by Zupancich to donate $100 to the Senior Citizen’s Annual Holiday party, monies to come from the Charitable Gambling fund. The motion carried on roll call vote with Councilor Prebeg and Tuomela absent.
It was moved by Stanaway and seconded by Zupancich to donate $200 to the MIB Cross Country Team, monies to come from the Charitable Gambling fund. The motion carried on roll call vote with Councilor Prebeg and Tuomela absent.
City Administrator reported on following:
It was moved by Zupancich and seconded by Stanaway to accept the audit proposal and award next year’s audit to Walker, Giroux & Hahne, in the amount not to succeed $24,500 for the City’s Governmental Funds and $11,000 for the Enterprise Funds with an additional fee of $3,000 if a federal single audit is required. The motion carried on roll call vote with Councilor Prebeg and Tuomela absent.
It was moved by Stanaway and seconded by Zupancich that the liquor and cigarette license applications for the period January 1, 2017 through December 31, 2017, be approved and issued to the following individuals and business establishments pursuant to the approval, where necessary, of the Liquor Control Commission and pursuant to the payment of all outstanding license fees and utility charges:

City Engineer report:
It was moved by Zupancich and seconded by Stanaway to approve Final Change Order No. 1 for the Garden Drive South project, with a decrease in the contract amount of $6,035.08 to Mesabi Bituminous, for the Garden Drive South Project. The Change order is to compensate the Contractor for work actually completed; the decrease in cost is due to the actual amount of materials and labor provided. The motion carried on roll call vote with Councilor Prebeg and Tuomela absent.
It was moved by Zupancich and seconded by Stanaway to approve Pay Request No. 2 for the Garden Drive South project, in the amount of $4,626.60, to Mesabi Bituminous, for the Garden Drive South Project. This pay request releases all of the retainage for this project. The motion carried on roll call vote with Councilor Prebeg and Tuomela absent.
It was moved by Zupancich and seconded by Stanaway to approve Pay Request No. 2 for Woodland Estates Residential Development Phase 1 project in the amount of $188,860.24, to Mesabi Bituminous. This amount includes withholding 5% retainage on work completed to date. The motion carried on roll call vote with Councilor Prebeg and Tuomela absent.
It was moved by Stanaway and seconded by Zupancich to authorize staff to advertise for seasonal/part-time rink attendants in the Recreation Department. Deadline for applications is Friday, December 2nd at 3pm. The motion carried with Councilor Prebeg and Tuomela absent.
It was moved by Stanaway and seconded by Zupancich to authorize staff to advertise for Fire Captain Truck Inspection Officer, Fire Captain Safety Officer and Assistant EMS Director. Deadline for applications is Tuesday, November 15th at 4pm. The motion carried with Councilor Prebeg and Tuomela absent.
It was moved by Stanaway and seconded by Zupancich to approve the recommendation from the Health and Safety Committee authorizing Policy Number 2016-04, Mountain Iron Fire Department Fitness reimbursement policy and contract with Anytime Fitness. The motion carried with Councilor Prebeg and Tuomela absent.
It was moved by Stanaway and seconded by Zupancich to accept Resolution Number 44-16; to get on board with the communities within the area to oppose the engineering feasibility and cost analysis standards of the Minnesota Pollution Control Agency (MPCA) in regards to the wild rice sulfate standards for the Wastewater Treatment Plants (a copy is attached and made a part of these minutes). The City of Mountain Iron also requests on behalf of the greater Minnesota residents in the Taconite Assistance Area, as well as all of Minnesota, the MPCA shall schedule public hearing sessions in locations across greater Minnesota, not just in St. Paul, to assure attendance by rural residents and local elected officials as the vast majority of communities that may be impacted by the new standard are likely to be located in greater Minnesota. The motioned carried with Councilor Prebeg and Tuomela absent.
It was moved by Zupancich and seconded Stanaway to authorize Sundberg Enterprises, LLC, DBA: The Sawmill Saloon and Restaurant to serve alcohol for events November, 19th, November 26th and January 19th, 2017. The motioned carried with Councilor Prebeg and Tuomela absent.
At 7:15p.m., it was moved by Skalko and seconded by Stanaway that the meeting be adjourned. The motion carried with Councilor Prebeg and Tuomela absent.
