MOUNTAIN IRON CITY COUNCIL

August 15, 2022

Mayor Anderson called the City Council meeting to order at 6:30p.m. with the following members present: Councilor Ed Roskoski, Joe Prebeg Jr., Julie Buria, and Mayor Peggy Anderson. Also present were: Craig Wainio, City Administrator; Tim Satrang, Public Works Director; Anna Amundson, Library Director/Special Events Coordinator, Amanda Inmon, Municipal Services Secretary; Al Johnson, City Engineer; Bryan Lindsay, City Attorney; and SGT Grant Toma, Sheriff’s Department.

It was moved by Prebeg and seconded by Buria that the consent agenda be approved as follows:

  1. Approve the minutes of the August 1, 2022 regular meeting as submitted.
  2. That the communications be accepted and placed on file and those requiring further action by the City Council be acted upon during their proper sequence on the agenda.
  3. To acknowledge the receipts for the period August 1-15, totaling $1,079,106.07 (a list is attached and made a part of these minutes),
  4. To authorize the payments of the bills and payroll for the period August 1-15, totaling $312,894.21 (a list is attached and made a part of these minutes).

Public Forum:

The Mayor reported on the following:

  • Thanks to citizens of Mountain Iron, the Sheriff’s Department, City Crew, vendors, Merritt Days Committee members, Fire Department as well as musicians and events for a very successful 2022 Merritt Days

It was moved by Prebeg and seconded by Roskoski to approve the request from Range Association of Municipalities and Schools (RAMS), supporting the letter requesting that Governor Walz and our Legislative Leaders to agree to a legislative special session and pass the remaining unfinished business from the regular legislative session. Councilor Prebeg amended the motion and Roskoski seconded eliminating the one sentence stating, “that our town had a bonding request for money.” The motion carried.

City Administrator:

It was moved by Prebeg and seconded by Buria to approve the included agreement as presented with the Salvation Army for their Heat Share program for the 2022-2023 winter season. The motion carried.

Director of Public Works:

  • CIPP lining of sewers of old downtown area, hot steam being used during the process
  • City Crews fixing streets where storm sewers were patched/repaired
  • City Crews jetting sewers in the next couple of weeks

Library Director/Special Events Coordinator:

  • Summer reading program ends August 26th
  • Annual Tie-dye day, Wednesday, August 10th, roughly 160 participants

Sheriff’s Department:

City Engineer:

  • CIPP lining in downtown, during curing process could be minor smells with brief interruptions possibly and some steam

City Attorney:

It was moved by Prebeg and seconded by Roskoski to approve Resolution #12-22; Calling For A Special MN Legislature Session (a copy is attached and made a part of these minutes). The motion carried.

It was moved by Buria and seconded by Prebeg to authorize BG’s Bar and Grill, to serve and sell alcohol at the Johnson-Krahl Wedding Reception scheduled for September 10, 2022 at the Senior Center. The motion carried.

It was moved by Prebeg and seconded by Buria to reschedule the Monday, September 5, 2022 meeting due to the Labor Day Holiday to Wednesday, September 7th at 6:30pm at the Mountain Iron City Hall. The motion carried.

The MIB Quarterback Club requests contribution for their 2022 Ranger Football Season, for assistance in purchasing safety equipment, other football equipment as well as for defraying traveling expenses. It was moved by Roskoski and seconded by Buria to donate $250.00 to the MIB Quarterback Club for their 2022 Football Season, monies to come out of the Charitable Gambling Fund. The motion carried.

Mayor Anderson called the City Council meeting to order at 6:30p.m. with the following members present: Councilor Ed Roskoski, Joe Prebeg Jr., and Mayor Peggy Anderson. Public Forum:

  • Jerry Kujala, Zoning Administrator spoke in regards shipping containers used at accessory buildings being painted earth-tone colors as stated in the City Ordinance, as well as residents using RV’s as dwellings, Ordinance states they can be used as seasonal cabins only not permanent usage, was wondering what other cities do in response to this

It was moved by Prebeg and seconded by Anderson to authorize Mr. Nathan Welch to become a permanent employee and continue his employment as a mechanic for the City of Mountain Iron, as he completed his probationary period. The motion carried with Councilor Buria absent.

It was moved by Roskoski and seconded by to accept the Fire Department report as presented. The motion failed due to lack of support.

It was moved by Prebeg and seconded by Anderson to approve Resolution #11-22; Declaring Cost to be Assessed, and Ordering Preparation of Proposed Assessment (a copy is attached and made a part of these minutes). The motion carried with Councilor Buria absent (Yes: Anderson, Prebeg; No: Roskoski).

It was moved by Prebeg and seconded by Roskoski to approve the request to by the Merritt Days Committee and close roads/block off the following streets in Old Downtown for the Merritt Days Celebration:

  • Wednesday, August 10th – Music in the Park
  • Locomotive Park from 4:00pm-8:00pm
  • Friday, August 12th – Sunday, August 14th
  • Mountain Iron Avenue from Locomotive Park (north) to the alley behind Benchmark Engineering (south)
  • Main Street from Slate Street (west) to Marble Avenue (east) with barricades on the adjoining alleys along Main Street

July 18, 2022

Mayor Anderson called the City Council meeting to order at 6:30p.m. with the following members present: Councilor Ed Roskoski Julie Buria, Joe Prebeg Jr., and Mayor Peggy Anderson. Also present were: Craig Wainio, City Administrator; Tim Satrang, Public Works Director; Anna Amundson, Library Director/Special Events Coordinator, Amanda Inmon, Municipal Services Secretary; Bryan Lindsay, City Attorney; Al Johnson, City Engineer; and Grant Toma, Sheriff’s Department.

It was moved by Prebeg and seconded by Buria that the consent agenda be approved as follows:

  1. Approve the minutes of the July 5, 2022 regular meeting as submitted.

Public Forum:

  • No one spoke during the regular meeting public forum

It was moved by Prebeg and seconded by Buria to recess the regular City Council meeting, and open the Public Hearing on Street Improvement Number MI-22 CE. The motion carried.

  • Al Johnson, City Engineer spoke, part of the process of assessing the properties for the street improvement, feasibility study conducted, full re-construct of the street along with new curb and gutter, would improve not only the crumbling of the street but help improve drainage, the assessed amounts are only preliminary, actual amounts are based on bid amounts and the total amount of the overall project
  • Jerry Pietrini, owner of property opposite side of UPS, street to “no-where,” opinion the road is ok the way it is, would hate to pay more street assessments, assessments add a large chunk to your property taxes
  • John Roskoski, owner of North Star Cycle spoke, owns roughly 50ft of the street, received two different amounts regarding the total amount of the project, 50% of one total is different than the other, is drainage going to be taken care of properly. Mr. Roskoski stated that there was leftover grant money, when 16th Avenue was complete, along with the leftover money, Mr. Roskoski stated that himself and others were assessed, says the leftover money could be used to put a couple more inches of blacktop on the street
  • Lee Aultman, only avenue to access property, especially for UPS and its employees, agrees with the street improvement to help with better access to local businesses
  • Discussion ensued

It was moved by Prebeg and seconded by Buria to close the Public Hearing on Street Improvement Number MI-22 CE, and reconvene the regular City Council meeting. The motion carried.

Walker, Giroux, and Hahne, LLC. Representative, Tom Kelly discussed the City of Mountain Iron’s 2021 Audit, overall fund position and recommendations for the City.

It was moved by Roskoski and seconded by Prebeg to accept the 2021 Mountain Iron City Audit as presented, and make any recommend internal changes if not already implemented. The motion carried.

It was moved by Buria and seconded by Roskoski to approve Pay Request No. 5 – for the Proposed Well #3, Bid Package 3 project in the amount of $2,372.62, to Bougalis Inc., Hibbing, MN. This amount includes a 5% retainage. The motion carried on roll call vote (4:0).

It was moved by Prebeg and seconded by Buria to approve Change Order No. 2 – for the Sanitary Sewer Improvement project, with an increase of $12,750.00 and extends the completion date to the end of August, for Insituform Technology, Anoka, MN. The motion carried on roll call vote (4:0).

  • Health & Safety Board discussed the possibility of connecting Carriage Homes, Nichols Town Hall, Raintree Apartments, Park Villa Apartments, Park Place and Rock Ridge are, across 169 highway to MIB School via sidewalk

It was moved by Prebeg and seconded by Buria to approve Resolution #09-22; Approving Improvements and Preparations of Plans (a copy is attached and made a part of these minutes). The motion carried (Yes: Anderson, Prebeg, Buria; No: Roskoski).

It was moved by Prebeg and seconded by Roskoski to approve Resolution #10-22; Opting to Increase the Benefit Level for Firefighters who are Vested in the Statewide Volunteer Firefighter Plan (a copy is attached and made a part of these minutes). The motion carried.

It was moved by Buria and seconded by Roskoski to approve Resolution #07-22; Authorizing the City of Mountain Iron to Make an Application and Accept Funds from the Community Infrastructure Grant Program from The Department of the IRRR (a copy is attached and made a part of these minutes).   • City crew will be out repairing storm sewer drains as well as throughout the City
  • City crew members making repairs on sanitary sewers in downtown, plan to be CIPP (slip-lined)

It was moved by Roskoski and seconded by Buria to approve the recommendation by the Library Board to allow Library Staff to participate in the “Fresh Start Summer,” program. This program would waive all previous lost item fees, as well as waive all previous fine/fees if possible from participating Libraries and update the Lost Item Policy. The motion carried on roll call vote (4:0).

It was moved by Prebeg and seconded by Buria to approve the recommendation of the Personnel Committee and hire Mr. Arren Schroyer, to the Mountain Iron Fire Department as paid on call firefighter, contingent on physical and background check. The motion carried.

It was moved by Prebeg and seconded by Buria to reschedule the Monday, July 4, 2022 meeting due to the 4th of July Holiday to Tuesday, July 5, 2022 at 6:30pm in the Mountain Iron Room, at the Mountain Iron City Hall. The motion carried.

Director of Public Works:

  • City Crews worked on water line break near Sherwin Williams/Sawmill, as well as near L&M
  • 1st leak near several utility services, worked all night long, valve installed south of leak
  • Total of 4 digs completed from Friday to Monday morning
  • Other crew members were called out to help with issues from the big storm recently received

It was moved by Prebeg and seconded by Buria to authorize the purchase of 10 1.5yd Poly Dura Kans and 30 2yrd Poly Dura Kans Recycling Containers from Nedland Industries, Inc. in the amount of $26,145.00. The motion carried on roll call vote (4:0).

It was moved by Prebeg and seconded by Anderson to send a letter from the City Council to the City Crew members, commending them for their hard work, during not only the numerous water line breaks, but also the time that they put in along with their dedication. The motion carried.

It was moved by Prebeg and seconded by Buria to approve Pay Request No. 5 – for the Proposed Well #3, Bid Package 2 project in the amount of $24,225.00, to TNT Construction Group, LLC, Grand Rapids, MN. This amount includes a 5% retainage. The motion carried on roll call vote (4:0).

 

It was moved by Roskoski and seconded by to accept the Fire Department report as presented. The motion failed due to lack of support.

 

It was moved by Prebeg and seconded by Roskoski to accept the recommendation of the Utility Advisory Board and approve the large trash pick-up for City of Mountain Iron residents with garbage service fee of $10.00, scheduled for the first couple of weeks of June. Complete form and payment must be turned in and paid for by May 27th by 4pm, with utility bill current. The motion carried.

 

It was moved by Buria and seconded by Prebeg to approve the Letter of Understanding as presented between the City of Mountain Iron and local AFSCME. The motion carried.

 

It was moved by Buria and seconded by Roskoski to approve Resolution #06-22; Authorizing the City of Mountain Iron to make an Application to and Accept Funds from the Residential Redevelopment Grant Program (a copy is attached and made a part of these minutes). The motion carried.

The Mayor reported on the following:

  • Sexual Assault Awareness month is intended to bring awareness to the fact that sexual violence is widespread and is a public health concern for individuals, families, community members and communities as a whole.
    • Child sexual abuse/exploitation, rape and sexual harassment impact all communities as seen by the national statistics
    • Within the fiscal year of 2020 and 2021, our local Sexual Assault Program has worked with 850 primary and secondary crime victims of sexual violence who reside in our communities. The Program has provided more than 37,000 documented trauma and victim-focused advocacy services with these crime victims
    • The Sexual Assault Program of Northern St. Louis County encourages every person to speak out when witnessing acts of violence, however small; and to help survivors connect with community allies

It was moved by Buria and seconded by Anderson to proclaim April 2022 as Sexual Assault Awareness Month and publish proclamation in the Hometown Focus and post on social media. The motion carried with Councilor Prebeg absent.

It was moved by Anderson and seconded by Roskoski to declare a vacancy on the City Council, and that the public will fill this vacancy during the November 2022 General Election. The motion carried (2:1) with Councilor Prebeg absent.

  • Minnesota Power crew members working on raising power lines near YMCA area, which will be a connection between the North and South side of the highway, part of the process to upgrade Mountain Iron’s power system

It was moved by Buria and seconded by Roskoski to approve Pay Request No. 2 – for the Proposed Well #3 project in the amount of $11,400, Pay Request No. 3 in the amount of $4,750 and Pay Request No. 4 in the amount of $11,439.90, to TNT Construction Group, LLC, Grand Rapids, MN. This amount includes a 5% retainage. The motion carried on roll call vote (3:0) with Councilor Prebeg absent.

It was moved by Buria and seconded by Anderson to approve Change Order No. 2 – for the Proposed Well #3 project, with an increase of $50,865 and extend the completion date to July 1, 2022 for Peterson Well Drilling, Mountain Iron, MN. The motion carried on roll call vote (3:0) with Councilor Prebeg absent.

It was moved by Anderson and seconded by Buria to approve Change Order #1 – for the Downtown Sanitary Sewer Slip-lining Improvement Project to extend the completion date to Friday, July 15th, for Insituform Technologies USA, Inc. The motion carried with Councilor Prebeg absent.

It was moved by Roskoski and seconded by to accept the Fire Department report as presented. The motion failed due to lack of support with Councilor Prebeg absent.

It was moved by Anderson and seconded by Buria to authorize City Staff to advertise for temporary seasonal employees for the 2022 summer months. Once a list of potential employees is developed, it will be forwarded to City Council for final approval. The motion carried with Councilor Prebeg absent.

It was moved by Roskoski and seconded by Buria to accept the recommendation of the Parks and Recreation Board and approve the enclosed agreement, hiring Mrs. Donna Johnson for the West Two Rivers Campground caretaker for the 2022 season. The motion carried with Councilor Prebeg absent.

It was moved by Buria and seconded by Roskoski to accept the recommendation of the Personnel Committee and extend an offer the Laborer position pending physical, drug/alcohol test and background check to the following individuals:
